PASSENGER TERMS AND CONDITIONS

STERLING SHUTTLE AND TOURS LLC | Effective 9/2/26

These Passenger Terms & Conditions ("Terms") are a contract between the person who books or uses a Service ("you" or "Passenger") and  BLUE STAR ENTERPRISES, LLC, doing business as Sterling Shuttle and Tours, LLC ("Sterling," "we," "us," or "our"). "Service" means any shuttle ride, public tour, casino trip, special-event trip, private charter, airport transfer, or related service Sterling provides.

1. Agreement and authority to book

By checking the acceptance box, signing, paying, boarding, or using a Service after receiving access to these Terms, you agree to them. The person making a group booking represents that the person is authorized to make the reservation and must provide these Terms to every Passenger before travel. Each adult Passenger agrees individually. A parent or legal guardian accepts for a minor only to the extent permitted by law.

If product-specific written terms conflict with these Terms, the product-specific terms control only for that product. No oral statement changes these Terms unless Sterling confirms the change in writing.

2. Booking information, prices, and payment

You must provide accurate contact, Passenger-count, pickup, accessibility, and itinerary information. Prices are in U.S. dollars and include only items expressly identified in the booking confirmation. Venue admission, meals, gratuities, parking, lodging, gambling funds, and personal expenses are excluded unless expressly included.

Payment is due as stated at booking. Sterling may correct an obvious pricing or description error before performance; if you do not accept the correction, your sole obligation is cancelled and Sterling will refund amounts paid for the affected Service. Tips are always optional.

3. Passenger eligibility and minors

A Passenger under 18 must travel with a parent, legal guardian, or responsible adult specifically authorized by the parent or guardian, unless Sterling agrees otherwise in writing. The accompanying adult is responsible for the minor throughout the trip. Destination age restrictions apply; casino gaming areas and alcohol-related activities may be restricted to persons 21 or older. Valid government-issued identification may be required.

Sterling may decline or end transportation when a Passenger cannot be transported safely or lawfully, provided Sterling will not discriminate unlawfully and will consider reasonable modifications for a Passenger with a disability.

4. Seat belts, child restraints, and seating

Every Passenger must occupy a separate designated seat and use the installed seat belt whenever the vehicle is moving or whenever the driver directs. Lap-riding is not permitted. The driver may refuse to move the vehicle until all Passengers are properly restrained.

The booking adult is responsible for notifying Sterling that a child will travel and for supplying a lawful, unexpired, undamaged child safety seat or booster appropriate for the child and compatible with the vehicle, unless Sterling expressly agrees in writing to provide one. The child's parent, guardian, or caregiver must install the restraint and secure the child. Sterling and its driver may inspect for obvious problems and may refuse transportation when a lawful restraint is unavailable or appears unsafe, but do not certify or guarantee a Passenger-supplied restraint or its installation. Any refund or rebooking is governed by Section 6.

5. Pickup, punctuality, itinerary, and missed service

Times are estimates unless Sterling expressly states otherwise. You must be at the confirmed pickup point, ready to board, at least 15 minutes before departure. The driver is not required to wait beyond the communicated grace period. A late or absent Passenger may be treated as a no-show and is responsible for arranging and paying for alternate transportation.

Traffic, weather, road closures, emergencies, venue operations, Passenger needs, and safety considerations may require a reasonable change in route, stop, vehicle, driver, schedule, or itinerary. Sterling may substitute a reasonably comparable vehicle or qualified carrier. Safety decisions belong to the driver. Sterling does not guarantee arrival by a particular time, a particular view or wildlife sighting, venue admission, gaming result, weather, or the availability of third-party goods or services.

6. Passenger cancellations, changes, and no-shows

Unless the booking page states a different written cancellation policy, the following default applies to public per-seat trips: cancellation at least 7 full calendar days before departure receives a refund to the original payment method, less any disclosed nonrefundable third-party charges; cancellation 48 hours to less than 7 days before departure receives a 25% refund; cancellation less than 48 hours before departure, late arrival, or no-show is nonrefundable.

For private charters and custom trips, the booking confirmation will explain the deposit, progress payments, cancellation policy, overtime charges, and minimum charge that apply specifically to that trip. If those rules differ from the general cancellation policy above, the rules in the booking confirmation will apply.  Passenger substitutions are permitted before departure if lawful, the substitute meets all eligibility requirements, and Sterling is notified. Sterling may make a reasonable exception for documented emergencies but is not required to do so. Any stricter product policy must be conspicuously disclosed before payment.

7. Cancellation or interruption by Sterling

Sterling may cancel, delay, shorten, or end a Service when reasonably necessary for safety, unlawful conditions, vehicle or driver unavailability, insufficient enrollment disclosed for that trip, severe weather, road closure, emergency, government action, or circumstances outside Sterling's reasonable control.

If Sterling cancels before departure and does not provide a reasonable substitute, you may choose a refund of the amount paid to Sterling for the cancelled Service or a credit of equal value. If a trip is interrupted after departure, Sterling will use reasonable efforts to protect Passengers and provide or arrange reasonable return transportation; any refund or credit will be fair in light of the portion performed, cause of interruption, and amounts Sterling can recover from third parties. Nothing here limits rights that cannot lawfully be limited.

8. Passenger conduct and removal

Passengers must follow driver instructions and behave in a manner that does not endanger, harass, threaten, obstruct, or materially disrupt others. The following are prohibited:

violence, threats, harassment, discrimination, indecent conduct, or abusive language;

illegal drugs, unlawful weapons, smoking, vaping, open flame, tampering with safety equipment, or illegal activity;

standing or moving about while the vehicle is moving unless the driver authorizes it;

intoxication or impairment that creates a safety risk, requires unreasonable supervision, or materially disrupts the Service;

consuming alcohol in the vehicle unless Sterling expressly permits it and all legal requirements are met; and

soiling, damaging, or interfering with the vehicle, driver, other Passengers, or third-party property.

Sterling may deny boarding or remove a Passenger at a reasonably safe location when the Passenger violates this section or creates a safety or legal risk. When practicable, Sterling will give a warning and an opportunity to correct the behavior. No refund is owed for removal caused by the Passenger. The Passenger remains responsible for lawful cleanup, repair, replacement, towing, lodging, or alternate-transportation costs caused by the Passenger, subject to documentation and applicable law.

9. Alcohol, cannabis, gambling, and destination activities

Sterling provides transportation, not supervision or advice concerning alcohol, cannabis, gambling, hiking, swimming, wildlife, food, or other destination activities. Passengers must obey applicable law and venue rules, make their own responsible choices, and never bring an unlawful substance or open container into the vehicle. Sterling may refuse return transportation until it can be provided safely or may arrange emergency assistance when reasonably necessary.

Gambling involves risk of financial loss. Alcohol and cannabis impair judgment. Sterling does not guarantee winnings, promotions, free play, food-allergy safety, or third-party offers. Passengers should confirm venue terms directly.

10. Health, mobility, and personal assistance

Passengers are responsible for deciding, with appropriate medical advice when needed, whether they can safely participate. Tell Sterling before booking, or as soon as reasonably possible, about mobility devices, oxygen, significant boarding assistance, or other accommodations needed so Sterling can assess and arrange reasonable service. Advance notice helps planning but is not a condition of receiving a legally required accommodation.

Drivers may provide reasonable boarding assistance but do not provide medical care, personal care, lifting beyond safe and lawful limits, continuous supervision, medication management, or custodial services. A Passenger who needs personal or medical assistance must travel with a qualified companion at the Passenger's expense unless applicable law requires otherwise. In an apparent emergency, Sterling may contact 911 and follow responder instructions.

11. Accessibility and service animals

Sterling does not discriminate on the basis of disability and will make reasonable modifications and provide assistance as required by applicable law. Service animals are permitted as required by law and are not subject to a pet fee. A service animal must remain under its handler's control and may be excluded only when the law permits, such as when the animal is out of control and the handler does not take effective action or the animal is not housebroken. Emotional-support, comfort, and pet animals are not service animals under the ADA and are permitted only under Sterling's current pet policy.

Sterling will safely stow mobility aids to the extent feasible and lawful. Because vehicle accessibility and securement capabilities vary, contact Sterling at 541-246-0811 or patricia@sterlingshuttle.com, so we can identify available options. Sterling will discuss reasonable alternatives when a requested arrangement cannot be provided safely in the scheduled vehicle.

12. Baggage and personal property

Bring only property that can be transported safely in the space confirmed. Label valuables and keep medicines, identification, money, electronics, keys, and irreplaceable items with you. Firearms, hazardous materials, illegal items, leaking containers, and property that blocks aisles or exits are prohibited.

Sterling is not an insurer of personal property. To the fullest extent permitted by law, Sterling is responsible for direct physical loss or damage to baggage only when caused by Sterling's failure to use legally required care, and not for ordinary wear, hidden defects, inadequate packing, unattended items, or loss at third-party locations. Report lost or damaged property promptly. Sterling may dispose of perishable, unsafe, or unlawful items and may donate or discard unclaimed property after reasonable notice and at least 30 days, consistent with applicable law.

13. Third-party venues and providers

Venues, restaurants, attractions, lodging providers, ticket platforms, and substitute carriers are separate businesses unless the booking confirmation expressly says otherwise. Their rules and terms may apply. Sterling is not responsible for their acts, omissions, closures, cancellations, accessibility, food, property conditions, or representations except to the extent Sterling is legally responsible for its own selection, coordination, representations, or conduct. Claims against a third party remain subject to that party's terms and applicable law.

14. Assumption of ordinary and destination-specific risks

You understand that travel and tour participation involve ordinary risks that cannot be eliminated even when reasonable care is used. These may include traffic and sudden vehicle movement; boarding and exiting; uneven, wet, icy, steep, or unpaved surfaces; weather, heat, cold, smoke, altitude, wildlife, crowds, crime, communicable illness, food allergens, and the independent conduct of other travelers and third parties.

You voluntarily accept those inherent and ordinary risks that are not caused by Sterling's breach of a legal duty. This section does not release Sterling from liability for negligence, gross negligence, reckless or intentional misconduct, violation of law, or any responsibility that cannot lawfully be waived.

15. Sterling's safety commitment and limits of responsibility

Sterling will use the degree of care required by applicable law in operating its transportation services. Nothing in these Terms reduces that duty or makes a Passenger responsible for Sterling's negligence.

To the fullest extent permitted by law, Sterling is not liable for indirect, incidental, special, consequential, exemplary, or purely economic losses—such as lost income, missed reservations, missed events, loss of enjoyment, or the cost of independently booked travel—arising from delay, itinerary change, third-party conduct, or circumstances outside Sterling's reasonable control. This limitation does not apply to personal injury, death, or direct property damage caused by Sterling's breach of a legal duty, or where applicable law prohibits the limitation.

16. Passenger responsibility and indemnity

You are responsible for direct losses, claims, fines, cleanup costs, and reasonable expenses caused by your unlawful conduct, intentional misconduct, reckless conduct, material breach of these Terms, or damage you cause. To the fullest extent permitted by law, you will indemnify and defend Sterling from third-party claims arising from that conduct. This obligation does not apply to the extent a claim was caused by Sterling's negligence, gross negligence, reckless or intentional misconduct, or violation of law.

17. Photos, recordings, and privacy

Sterling may use vehicle security or dash cameras for safety, incident documentation, and legal compliance where lawful. Sterling will handle personal information in accordance with its posted Privacy Notice and applicable law.

Promotional use of a Passenger's identifiable image, voice, testimonial, or likeness requires separate affirmative permission. Declining promotional consent will not affect service. Passengers may take personal photos only if they respect others' privacy, follow venue rules, and do not distract the driver or interfere with safety.

18. Complaints, incidents, and claim cooperation

Tell the driver promptly about an immediate safety concern. For a complaint, injury, property issue, or service dispute, contact Sterling at 541-246-0811 as soon as reasonably possible and provide the booking number, date, facts, witnesses, and available supporting material. Prompt notice helps preserve evidence but does not shorten any legal limitation period or waive rights that cannot lawfully be waived.

The parties agree to cooperate in good faith and first attempt to resolve a dispute through direct discussion. Either party may request nonbinding mediation by a mutually agreed mediator. Mediation is voluntary unless the parties later agree otherwise in writing.

19. Governing law and forum

Oregon law governs these Terms without regard to conflict-of-law rules. Subject to any law requiring a different forum, an action relating to these Terms or a Service must be brought in a state or federal court with jurisdiction in Lane County, Oregon. Either party may bring an eligible matter in small claims court. Nothing in this section prevents a party from seeking emergency injunctive relief or exercising a nonwaivable statutory right.

20. Force majeure

Sterling is not in breach for delay or nonperformance caused by events beyond its reasonable control, including severe weather, wildfire or smoke, road closure, natural disaster, epidemic, government order, civil disturbance, labor disruption, utility or communication failure, sudden vehicle failure despite reasonable maintenance, or sudden driver illness despite reasonable staffing. Sterling must use commercially reasonable efforts to reduce the impact and fulfill the remedies stated in Section 7.

21. Changes to these Terms

The Terms in effect when you book govern that booking unless a change is required by law or you affirmatively agree to it. Sterling may update these Terms for future bookings by posting a revised version with a new effective date. A material change will not retroactively reduce rights for an existing booking without your affirmative agreement.

22. Severability, survival, and entire agreement

If a provision is held unlawful or unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions will remain effective. Provisions that by their nature should survive— including payment obligations, responsibility for damage, dispute provisions, and limitations—survive completion or cancellation. These Terms, the booking confirmation, and incorporated product-specific terms are the entire agreement concerning the Service and replace prior discussions about the same subject.
